August 2024 Update: Case Law summary for the month from across New Zealand.

Key decisions include cases where employers were justified in dismissals for reasons such as threats of harm, medical incapacity, and breaches of notice periods, while others involved unjustified dismissals due to flawed processes such as invalid trial periods and miscommunications during redeployment.

The courts also overturned several Authority decisions, including suspensions and dismissals, emphasizing the importance of fair and reasonable procedures. There were cases included where employers failed to adhere to proper employment agreement protocols, leading to breaches and compensation claims.
